Terms and Conditions
Welcome to Owla Care. By accessing or using our platform (the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully. If you do not agree, you may not use our services.
1. Definitions
“Family User”: any person who registers on the Platform to request night-time care services for an elderly relative (“Elderly”).
“Owl User”: any person who registers on the Platform to provide night-time care services (the “Services”) as an independent professional.
“Elderly”: the person benefiting from the Services, as designated by a Family User.
“Platform”: the Ernesti website and mobile application, including shared calendars, messaging, notepad, and payment functionalities.
“Owla Care” / “We”: the operator of the Platform.
2. Purpose of the Platform
The Platform connects Family Users seeking night-time care for their Elderly with Owl Users offering such Services. Owla Care provides:
A shared calendar to arrange shifts,
Messaging and notepad functionalities,
A payment and invoicing system.
Owla Care does not employ Owl Users. Owl Users act as independent sole traders, setting their own rates and providing Services under their own responsibility.
3. User Accounts
Users must register and provide accurate, up-to-date information.
Each user is responsible for maintaining the confidentiality of their login credentials.
Use of the Platform is strictly personal. Accounts may not be shared or transferred.
4. Service Agreements
The Family User and Owl User must agree in advance on the terms of each shift (dates, duration, and rate).
Owla Care is not a party to these agreements. We facilitate contact, organisation and payment only.
Owl Users remain solely responsible for the performance of the Services.
5. Payments
Family Users must add funds to their wallet on the Platform before scheduling shifts.
When a Family User books a shift with an Owl User, the corresponding amount is reserved in their wallet.
Once the Owl User has confirmed the successful completion of the shift, the reserved funds are released and transferred to the Owl User.
Owl Users set their own rates per shift and issue invoices directly to Family Users.
Owla Care deducts a 12% commission fee from each payment made to Owl Users, before funds are transferred.
6. Responsibilities
Family Users: must provide accurate information about the Elderly’s needs and ensure a safe environment.
Owl Users: must provide Services with care, professionalism, and within the agreed terms.
Owla Care: provides the Platform and payment processing but is not liable for the quality, safety, or outcome of Services.
7. Liability
Owla Care is not responsible for:
The actions, omissions, or performance of Owl Users,
The conduct of Family Users,
Any damage, incident, or injury arising during or after a shift.
Owla Care’s liability is limited to the amount of commission fees received for the transaction concerned.
8. Data Protection
Owla Care processes personal data in accordance with applicable data protection laws (including GDPR).

9. Termination
Users may close their account at any time.
Owla Care may suspend or terminate accounts in case of fraud, breach of these Terms, or misuse of the Platform.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Kingdoms. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of London, unless otherwise required by law.
